Data control and responsibility
Law No. 13,709/18 (General Data Protection Law) details two main actors and their responsibilities in relation to data:
- a) Controller: is the company that controls the data. It is responsible for collecting and using the data as permitted by the data subject and in accordance with the purposes of the law. Considered by law as the primary data controller. Simply put, it is who is responsible for what will be done (“handling”) with the data.
- b) Operator: is the company that the controller uses to perform specific processing operations with the data, such as storing and processing the personal data collected. What is the purpose of the processing of personal data?

How is the data collected/processed?

In addition, the Eletropoll Group requires its data processors to update and test, in accordance with best practices, their security systems for the purpose of protecting your personal data. However, although we work to good security and protection practices, no web service is 100% guaranteed against intrusion and we cannot be held responsible if this should occur.
With whom can the data be shared?
For Web Site Users
Grupo Eletropoll will not disclose any personal data that directly identifies the User, without their prior consent, except in cases where disclosure is necessary to comply with legal obligations, by order of judicial or administrative authorities, to exercise a legal right or in order to achieve one of the purposes indicated in this Privacy Policy.

For Leads
Grupo Eletropoll may share your personal data with third parties or business partners, which are relevant for the purpose of enabling the relationship with you and the sending of the requested commercial proposal. This sharing occurs based on the following criteria and for the purposes described below.
Service providers: these companies work with the Eletropoll Group to enable or enhance the fulfillment of the purposes listed in the previous chapter (“For what purposes do we collect your data?”). Examples include services to (i) develop or enhance digital channels, and (ii) create/manage marketing actions for Grupo Eletropoll related directly or indirectly to Grupo Eletropoll’s digital channels, products and services. These vendors receive your information for the specific purpose of providing services to Grupo Eletropoll and do not have any rights to use your information outside of this circumstance. Some of the service provider applications that may receive your data are: GOOGLE, FACEBOOK, INSTAGRAM, RD STATION, YOUTUBE, AMONG OTHERS.

Databases of Grupo Eletropoll’s other digital channels: when you request a commercial proposal on a Web site of one of Grupo Eletropoll’s brands, your data will integrate the database of the digital channels of the other company brands. App Marketing, Grupo Eletropoll’s digital channel provider, is the data operator, providing only the license to use its CRM platform to Grupo Eletropoll. However, App Marketing, Grupo Eletropoll’s data carrier, may use electronic instructions, known as “cookies,” that are sent to your browser and stored on your computer’s hard drive.
The purpose of the cookies is to verify who are the users of Grupo Eletropoll’s digital channels, to eventually facilitate your navigation with the characteristics, preferences and quality of the information conveyed by your registered users.

What are the data subject’s rights?

Anonymization, blocking or deletion of unnecessary, excessive data or data treated in non-compliance with the provisions of the LGPD;
Portability of personal data to another provider of a service or product, subject to regulation by the national authority;
Erasure or anonymization of personal data processed on the basis of your consent, except where the law authorizes the retention of such data on another basis;
Information on the public and private entities with which Grupo Eletropoll has shared the use of your personal data;
Information about the possibility of not giving consent to the processing of your personal data and the consequences of such action;
Revocation of your consent, when the processing has been carried out on the basis of the holder’s consent.
Personal data will be processed for the period considered necessary to fulfil the purpose for which they have been collected and in order to protect the interests of the Eletropoll Group in relation to potential related liabilities. Consent possibly provided by you for other activities unrelated to the provision of a specific service requested may be revoked at any time. Upon revocation of consent, the data may no longer be processed for such purposes, although it may still be processed for the protection of Group Eletropoll’s interests.
How can I exercise my rights as a data subject?
